A residence permit (Permesso di Soggiorno) is a “document confirming the right to permanent residence on the territory of a state by a person who is not a citizen of that state, i.e., a foreign citizen.” In Italy, this document is issued at the Questura (immigration office) at the place of residence of the foreign citizen. According to Italian law, there are several reasons for obtaining a residence permit in Italy. Here are the main ones:
- «Lavoro autonomo» – engaging in individual professional activity (founder of a company or sole proprietor);
- motive «lavoro subordinato» – employment. Only when there are available quotas and an invitation from an Italian company;
- motive «ricongiungimento familiare» – family reunification;
- motive «studio» – study;
I would like to draw your attention to such a reason for obtaining a residence permit in Italy as a residence permit “by chosen place of residence.” The fact is that, based on the same Italian law, any foreign citizen who has purchased (or rented long-term) real estate in Italy has the right to apply for a residence permit for “chosen place of residence.” This type of residence permit requires the foreign citizen to have sufficient means of subsistence, excluding all types of employment in Italy. In Italian, this is the motive “Permesso di soggiorno per residenza elettiva.”
All the above reasons for obtaining a residence permit have their own duration and requirements for the foreigner applying for a residence permit in Italy. This document is usually issued for a period of 6 months to 2 years. Almost all types of residence permits can be renewed if the conditions for their issuance remain. Of course, there are exceptions. They are highly personalized.
A residence permit obtained by a foreigner in Italy gives him the same rights as Italian citizens, except for the right to vote. A foreign citizen has the right to work as an employee (with the exception of “residenza elettiva”) or to become a sole trader, on the same terms as Italian citizens.
After obtaining a residence permit and residency in Italy, you have the right to use free medical services, receive free education, legalize previously obtained diplomas and other certificates. You can freely move around the entire territory of Italy and the EU countries, and enjoy all the existing benefits and advantages of living in this country.
A residence permit in Italy is renewed at the request of its holder. The application for renewal must be submitted no later than three months before the expiration date of your current document.
All foreign citizens residing in Italy for at least 5 years are entitled by Italian law to be issued a residence permit for an indefinite period, that is, to be issued a document for permanent residence in Italy. Since January 8, 2007, this document is called – the EU long-term residence permit – «permesso di soggiorno CE per soggiornanti di lungo periodo». This type of residence permit in Italy is indefinite and is valid throughout all EU countries.
