For foreign citizens planning to engage in active professional activities in Italy or whose income depends on daily work, we offer another motivation for obtaining a residence permit. This is “Lavoro autonomo” – engaging in private business in Italy.
To obtain this type of residence permit, you will need to:
1. First, buy or rent property in Italy. The rental contract must be signed for a period of “4+4 years” and registered with the “Agenzia delle Entrate” in the province where the property is located. This is necessary to ensure you have a place of residence in Italy.
2. Decide on the type of business you will engage in while in Italy.
3. Our lawyers will help you write a motivation letter to the consul explaining the reasons why you want to start a business in Italy.
4. Our lawyers will prepare all the necessary documents from the Italian Chamber of Commerce, confirming that nothing prevents you from conducting the business you have chosen in Italy.
5. You, as the head of the family (later your entire family will receive a residence permit in Italy through the “family reunification” procedure), apply to the Consulate or Embassy of Italy in your country of residence to obtain a type “D” migration visa. You will need to gather a package of documents consisting of the above-mentioned documents and those necessary to obtain a type “D” visa (a complete list of documents can be found on the Italian Consulate’s website in Russia).
6. After receiving the type “D” visa, you fly to Italy, where our lawyers will help you prepare the initial necessary documents and assist you in setting up a business as an “Individual Entrepreneur” (Partita IVA).
7. Once you have the documents for opening the business, you apply for a residence permit with the motivation: “lavoro autonomo”.
8. After submitting the application for the residence permit, you wait for a call within 30 days and then undergo a series of standard procedures at the immigration office: fingerprinting, document verification.
9. After three months, you receive the “Permesso di Soggiorno”.
10. With a residence permit, you, as the head of the family, can request the activation of the “family reunification” process for all close relatives, allowing them to obtain a residence permit in Italy.
On average, from the preparation of documents to the receipt of the residence permit, it takes 4 to 6 months according to practice.
After 5 years of continuous residence in Italy, you, as a foreign citizen, have the right to request a “long-term residence permit in the European Union”. This is the so-called “permanent residence permit”. When applying for a “permanent residence permit”, you will need to pass an Italian language proficiency exam. During the waiting period for the residence permit, foreign citizens are allowed to leave the country if:
- You can provide a passport with a visa (D), based on which you are waiting for the residence permit, and a postal receipt confirming the submission of documents to the Questura;
- Your trip does not involve transfers through other Schengen countries. In this case, only direct flights are suitable. No transit connections;
- Minors (under 14 years old) waiting for the residence permit can leave the country only with a “temporary residence permit”, which is requested in such cases at the immigration office at the place of residence in Italy – “Questura”.
Due to the high level of bureaucracy, the immigration process to Italy is quite complex. It has many nuances and is unique to each family.
